e and spirit that comes from victory. >> reporter: like a lot of long- time 49ers fans. >> i'm disappointed they are going to santa clara. >> reporter: did you still consider them the san francisco 49ers. >> oh, yes in every way. >> reporter: what about their leaving the city. >> i would love to have the games here but at the same time, san francisco 49ers continue to be the name. >> reporter: look behind us. san francisco city hall, all lit up in red and gold for the 49ers. there's a good chance it will stay that way all the way through and that the mayor will be staying here as well because not only does he want to have a fun game and a victory, he wants to make sure the city stays safe no matter which way it goes. >> thank you. meanwhile, the 9ers held their first practice to prepare for the super bowl today. it's the first time that the team worked out since winning the nfc championship last sunday. you can see it was cloudy at the 49ers facility in santa clara. the practice was actually moved up 30 minutes to avoid even the

possibility of rain. the team has work to do in the next few days. the 9ers are set to fly to new orleans on sunday. center jonathan goodwin has won a super bowl so his advice? >> big thing this week is to take care of all the off the feel stuff, things like that. you know, say no to your distant cousins and new friends. just eliminate the headaches. >> once they arrive in new orleans, the players and coaches will be on a tight schedule which includes plenty of media interviews and other possible distractions leading up to the game. 49er players have been spotted around san jose especially after the team clinched the nfc championship game last weekend. you will see where they have been hanging out a little later in this newscast. plus, how the superdome is gearing up for the big game and i sneak peek at the super bowl -- and a sneak peek at the super bowl ads all still ahead. we are sending a team of reporters to cover super bowl xlvii in new orleans. our coverage will include

sports director dennis o'donnell, also vern glenn, michelle griego and mike sugerman. new at 6:00, a big turnout is expected at a contra costa county school district meeting tonight. it starts in an hour. parents are outraged that a special education teacher who abused a child is still employed. cbs 5 reporter da lin spoke with the child's mother. da. >> reporter: that's right, ann. the mother and a lot of parents in this district are disappointed that the district did not fire that teacher and already even though the meeting is in an hour, there are already parents sitting here waiting for the doors to open. this is the agenda right here. the meeting will be held in that room behind those doors in about an hour. the superintendent and the district's attorney will be here to answer those questions, why they did not fire that teacher. lawyers questioned special ed. teacher gina holt in the video about whether she dragged a special needs student out of his chair and kicked him.

>> i asked him about it. told me that it had happened at school. >> reporter: holt denied abusing the 5-year-old boy in 2010. yet she pleaded no contest to a count of misdemeanor child abuse. despite the conviction and a settlement of close to a million dollars between the brentwood school district and the boy's family, holder still works for the district. >> i was horrified and i'm horrified that she is still working. >> reporter: the boy's mother doesn't understand why the district won't fire the veteran teacher more than two years after the incident. in fact, holder taught special education students in the district right up until last month. she is now on paid administrative leave. holder will resign at the end of the school year. the district's superintendent declined to talk to me but one district official tells me a misdemeanor for a teacher doesn't mean an automatic dismissal.

the district says legal restrictions forced them to keep her on the payroll although no one could tell me which law prevents them from firing a teacher. >> if there's a bona fide reason that they are relying on a law that prevents them from firing her they should identify what is it rather than saying well, we just couldn't. >> reporter: district officials are meeting behind closed doors to talk about the case. they will open the doors in about an hour at 7:00 for the public to enter. i did call dina holder. her attorney says she has no comment at this time. this is the first public meeting that the district is holding and you can bet there will be a lot of questions from parents to the superintendent. live in brentwood, da lin, cbs 5. el cerrito police searching for two suspects in a shooting near the el cerrito bart station. this happened about 2:00 this afternoon on ohlone greenway. police say that two teenagers

were shot on a walking path near the station. they are not life-threatening wounds. they should be okay. the shooters are still on the loose. >> the only information we have about the suspects at the moment is that they were teenaged african-american males apparently both armed with han guns. >> as a precaution fairmont elementary school and el cerrito high school were on lockdown while police investigated the shooting. the schools were reopened later and students allowed to leave. a car stolen in san jose on monday turned up in the uvas reservoir. it was one of two cars stolen from the home of an elderly couple. three men forced their way into the house, tied up victims and took money and two camps. the other car was found in southern santa clara county. in san francisco the "all clear" in mission bay tonight after a construction worker found a suspicious looking box

near ucsf. roads were closed and some buildings around the campus were evacuated. the bomb squad determined that it was nothing more than a box of junk. in palo alto, police are looking for a gunman who robbed a man and woman last night. the victims say the robber stopped them on the sidewalk on ramona street then pulled out a gun and stole their wallets and her purse. and back out to oakland right now, another look at the burning building. we believe it's a house. fire crews trying to get a handle on it right now. it's near the city's chinatown. a lot of smoke still coming up. live pictures from chopper 5. first reports indicate the fire is burning inside a vacant victorian on the 600 block of harrison street. within the last few minutes we saw some flames from chopper 5 still coming from some of the windows. so firefighters you can see there are still busy trying to get this one under control. here's something we have not seen in quite a while. umbrellas, yeah, rain falling around parts of the bay area

today. this video from san francisco this afternoon. so where is it raining now? our chief meteorologist paul deanno shows us with our live hi-def doppler. >> i'm just happy everybody had the umbrella. they watched the forecast. yes, it was raining earlier still is right now. seg a big uptick in light rain moving up from the south. radar more active currently compared to an hour ago. light rain in oakland, san ramon, danville. notice no yellows there. no moderate rainfall, just some steady light rain where we do cielo and oranges and reds to our south. and that's where the rain is coming from. so a wave of heavier rain to move through this evening and it will hit you in the south bay first down towards san jose, working its way north. our computer is predicting about one-third of an inch of rainfall primarily between right now and tomorrow and the morning commute. so steady rainfall at times overnight tonight. that's not the only rain chance we have in the seven-day

spotted all over the south bay - including a hot spot where they tory over at the stars for the 49ers are being spotted all over the south bay including a hotspot where they celebrated their victory over atlanta. cbs 5 reporter len ramirez shows us how the players partied like champs. >> reporter: this one even surprised me. turns out that after the 49ers win versus atlanta and a cross- country plane trip home they didn't want to just go home and rest. they wanted to come out and party. and so they came out here to downtown san jose. ♪ [ music ]♪ reporter: the motif lounge was ready for a party on sunday night and that's exactly what it got as first reported by the celebrity gossip site tmz.

49ers stars rushed the downtown san jose nightclub after landing in the wee hours still wearing their caps and toasting their victory. tmz even got an exclusive shotcolin kaepernick and alex smith showing partying together. >> the crowd was going crazy. we had hundreds of people here. i had to turn people away because of occupancy. >> reporter: why motif and why san jose? some of the 9ers have reportedly taken up residence in the luxury high- rise behind the south first street nightclub zone. >> i guess i would be surprised. i november knew they would be around in downtown san jose. >> so many fun places to be in san francisco. but it's cool that they like to be down here. >> reporter: headquarters, stadium, the south bay is the 9ers' new home in more ways than one. they eat in the restaurants and shop for cars at the stevens creek auto mall. >> there's plenty of options including a great option for your super bowl prize. >> reporter: he didn't sell his lexus super car. he says he sells a lot of cars

to the 9ers but not so far his $400,000 lexus super car. he says the teams give a lot back to the area in return. >> the 9ers have brought excitement and interest down here and with it, it's that buzz that's unknown. it creates excitement everywhere. we saw it with the giants, earthquakes and now the 9ers. >> reporter: speaking of buzz, our source says that the 49ers did party but apparently didn't party too hearty but just in case, they live just about half a block away so if anything did happen, they would be within walking distance or even staggering distance from home. [ laughter ] >> excellent point. all right, len ramirez, thank you. hundreds of law enforcement officers will be on hand to keep the super bowl safe. new orleans will have more than 1,000 officers working 12-hour shifts starting next week. joining them will be hundreds of more sheriff's deputies and state police. that's not all. the feds will have plenty of homeland security agents as well as fbi and atf keeping an eye out for trouble.

new orleans ems crews are also preparing for super bowl sunday. they have been training for a year to handle just about anything. paramedics have a surge bus that can treat up to 18 patients at one time. they will also carry special computers that can translate dozens of languages. new orleans won't be on its own. cities such as baton rouge will be sending ems teams to help out. a breaking story in oakland right now. fire crews still trying to get a handle on a house fire near the city's chinatown. you can see they are pouring a lot of water on it. still a lot of smoke coming up. we believe it to be a wood frame victorian possibly vacant building that's burning on the 600 block of harrison street. flames still coming from some of the windows we can see as the helicopter pans these live pictures, still a lot of smoke, as well. chopper 5 will stave above it and keep an eye -- will stay above it and keep an eye on it. an artistic demonstration

could turn into a criminal case in san francisco. cbs 5 reporter anne makovec shows us the exhibit at the center of an investigation. reporter: this is the piece that was supposed to be celebrated with the gala reception tonight. instead, it caused a fire at the queens nail art gallery last night. >> it's really surprising that it actually created a fire. >> reporter: kelsey works at a coffee shop across the street. >> they told us, we're putting 50,000 matches in this part of the united states -- and they talk about how much work it was and ordering all these matches. >> reporter: and then at around 10 p.m., this was lit on fire on purpose and got out of control causing $5,000 in damage. it's part of an exhibition called they hate us for our freedom. here's another part of that demonstration. we found this video on youtube. here's the artist claire fontaine. she didn't want to speak on camera nor did the gallery owner citing a criminal arson

investigation. but neighbors weighed in. >> i mean, i get it. i think it's an interesting piece for sure. i think it makes its point. >> reporter: the fire department sees it differently. >> kids don't have to play with matches, so just don't do it. guy just didn't know what he was doing. he shouldn't have did what he did. but again, it's out of our hands. the police are investigating with the city attorney. >> reporter: ultimately, it will be up to the district attorney to decide whether or not to file criminal charges. in san francisco, anne makovec, cbs 5. all right. the real cold temperatures have moved out but guess what moved in, in its place. the rain. >> the rainfall. and it's a trade-off. isn't it every winter? we really had some cold weather the past several weeks actually. we have had temperatures running four or five degrees below normal. now we had cloud cover overnight and yes you have the rainfall. but you probably didn't have frost, did you? look at all that green on your screen. that's cbs 5 high-def doppler radar strongest most perfectly placed radar in the bay area picking up the rainfall and we are seeing the rain pick up in

the south bay along 280 and 101. we are seeing some light rain showers from redwood city south to palo alto, sunnyvale, campbell and almost into the city of san jose and milpitas. it will be raining in about 10 minutes but not right now. mainly cloudy skies outside kept our high temperatures down. oakland yesterday hit 67. today 1 1 degrees cooler, 56. you tied kentfield and hayward, san francisco at 56. fremont you hit 58. you were the warm spot today. livermore with the rain showers around only 52 degrees. so our influence of weather is now coming up from the south. you can see here about 12 hours of our weather data everything is lifting up from the south so let's look to the south to see what's next and we have plenty of showers hugging the coastline from here all the way south of san diego. so it will be about sunrise tomorrow before a front moves through and pushes all this moisture out to the east. when that happens we'll dry out. most of tomorrow will be dry but this evening and tonight will be soggy at times. high pressure hanging out for two days, dry on thursday and friday and then here comes the next low pressure area that will slide by giving us a

a nati the cost of everything super bowl is going up including the cost of chicken wings. >> a nationwide shortage is driving up prices to their highest ever. cbs 5 consumerwatch reporter julie watts says it's got wing fans crying fowl! >> reporter: the costs of chicken wings is 2.12 a pound making it the most expensive part of a chicken. what will you be eating this super bowl sunday? >> chickening wings. >> and some wings. >> reporter: they are a super bowl staple and this year football fans will chow down on 1.23 billion wings in just one weekend.

laid out end to end this weather stretch from candlestick to ravens stadium in baltimore 27 times! but he says this year those wings won't come cheap thanks to last year's drought. >> corn prices are high, chicken prices are up. >> reporter: as a result, farmers produced fewer chickens last year at a time when wings have become a restaurant staple. what used to be the cheapest part of the chicken considered a by-product has now become the most coveted. entire chains are devoted to the wing. >> each bird has only two weeks so that drives the cost up where as breasts, thighs and other parts will be cheaper. >> reporter: this year's super bowl wings will be the most expensive ever up 14% to about $2.11 per pound. >> 14%? guess i'll have to pay. >> it's once a year. >> reporter: they should be worried about shortages. >> get them as soon as you can. >> sooner the better.

>> reporter: this manager expects a wait for walk-ins up to two hours next sunday. and last year, many wings spots cut off free orders days before the big game. --preorders days before the big game. they expect to sell 2,000 pounds of wings sunday but many fans aren't leaving this super bowl staple to chance. >> i'll have them in the refrigerator right now. >> we are going to shop. >> i better place an order soon. >> reporter: if you plan to make wings, don't expect to buy them on game day. stores are expected to sell out. the good news is you can put hot wings sauce on almost anything. the recipes are online for shrimp, quesadillas. cheese because. even mac and cheese. i use it as salad dressing. and turns out the baby loves red-hot sauce. i have been putting it on cottage cheese. >> when you start making baby food -- >> some people like pickles and ice cream.

shooting from a house near downtown oakland. chopper five is over the 600 block of harriso an update on breaking story. more flames shooting interest a house near downtown oakland. chopper 5 overhead with these live pictures. this is a 600 block of harrison street. in the last few minutes, that fire has sparked back to life.

you can see the flames coming from the roof there as they continue the battle. fire crews on ladder trucks working the fire. the oakland, fire department has confirmed one person has been injured. that person is described as a civilian. no word on how badly hurt. no firefighters hurt in this one of the they are pounding that thing with fire. no word yet on how it got started. a major change tonight in how the city of okayed plans to use its newly hired super cop consultant. earlier this morning bill bratton won a city contract but this afternoon oakland leaders were already trying to lower his profile. cbs 5 reporter joe vazquez on what we can expect from bratton. >> what he is doing elsewhere it may have worked doesn't mean it's going to work here. >> reporter: the long lively oakland city council meeting lasted more than 7 hours. some spoke out for and many more against hiring the consultant known as the super cop. former police chief of los angeles and new york, bill bratton, an advocate of aggressive policing has been widely praised as an effective

crime fighter. he raised concerns among some activists. with a vote of 7-1, oakland city council approved his hiring as a consultant for $250,000. the council also added language to the contract that reiterate the city's opposition to racial profiling. >> bill bratton is neither as i said neither the devil for a saviour. he is part of a team. he is a person who developed a com stat system. >> reporter: he is scheduled to begin in three weeks. his first order of business is working on the computer based policing system to help the department come up with a citywide crime-fighting strategy. one major change announced today, he was slated to play a central role in a series of community meetings the police department is planning to have. today the chief announced that is no longer the case. >> based on some of the reaction from the community, we want to get things done. and what we're going to do is make other team members available to address community concerns.

i will be there myself along with my staff, mr. bratton will be available to meet with city leaders, and most importantly my internal staff. >> reporter: last week, bill bratton told me he was going to come to oakland february 10th. according to his contract, he will be on the ground off and on for several months. reporting live in oakland, joe vazquez, cbs 5. san jose police just released a sketch of a man a girl says tried to kidnap her. he grabbed her friday dragged her into a driveway at east same james and north 33rd. she fought back and the man ran away, she said. a thief with an educated palate pulled off a winehouse. the owner of the plumed horse restaurant discovered the theft with a broken window.

it will take weeks to determine what's missing but the restaurant's wine list features bottles that cost up to $10,000. in san francisco, firefighters put out a fire that damaged this home in hayes valley this morning. the house is on oak street near octavia. nobody is hurt. investigators looking into the cause. >> the passenger arrested at sfo with 100 cocaine pellets inside his body pleaded guilty to a federal drug charge. 55-year-old emmanuel amanqua tried to board a flight to japan. he was arrested in august. he will be sentenced in april. at times defiant, other times despondent but secretary of state hillary clinton stood her ground as she testified today before congress about the deadly attack on the u.s. mission in benghazi. she rejected republican suggestions the administration misled congress about the september 11th assault that left four americans dead including ambassador chris 46 44 hadstevens.

and she choked up when she spoke of their murders. had [voice breaking ] >> i put my arms around the mothers and fathers, the sisters and brothers, the sons and daughters and the wives left alone to raise their children. >> clinton is serving her final days as secretary of state and many believe her testimony will leave a lasting impression should she run for president in 2016. a military taboo about to end. the ban on women in combat roles will be phased out soon. defense secretary leon panetta will make a formal announcement tomorrow but word is already out in washington that military chiefs will present plans to move female soldiers into new roles. that will be in may. the change will open up hundreds and thousands of front line jobs to women for the very first time. every year the super bowl ads get nearly as much attention as the game itself. tonight cbs 5 reporter linda

yee shows us one ad that sure to get a lot of attention and what advertisers are doing to make sure that you see it one way or another. >> reporter: here's a preview of super bowl xlvii ads. they are selling soda, candy and cars. to pick out just some of the commercials, at $4 million for a 30-second ad, the strategy this year is using social media to help sell the product even before kickoff. >> buzz before the game and buzz after the game means that that spot of yours won't just be seen during the game. >> reporter: the marketing professor at golden gate university says seeing the commercial before the game can score big points. >> it's not brand-new but i think there's more contests a little bit. some of them are offering prizes. if you watch the game if you see the ad you have a chance to win. >> reporter: example, coca- cola's ad. click on their site to watch it and decide who wins the

this afternoon, the company released earnings that were flat year to year. apple said sales in the current quarter apple stock is down dramatically. this afternoon the company released earnings that were flat year to year. apple said sales in the current quarter would grow just 7%. nowhere near the 50% growth rates of past years. today apple stock fell 55 points to close at $458 a share. that alone wiped out a year's worth of gains for apple. today the house voted to suspend the debt ceiling passing a bill that business the country another four months before it risks default but there's a catch. the bill is called no budget no pay. both chambers of congress have to pass a budget resolution or they don't get paid. house democrats against the bill call it a political gimmick. those in favor say it takes the threat of default off the table. we are hearing from manti

filling shelves with clothing, household items and attracting a steady stream of shoppers. >> this is amazing. >> reporter: marge started it with a $300 loan from her mother and a small group of volunteer moms in danville. they call themselves the friends of discovery. >> no one has had any experience at all in the mercantile business, hardly anybody has even had a job. >> reporter: today, the thrift station is one of the top 25 businesses in the san ramon valley and all of its profits support community mental health. >> we have been coming here for 30 years. i'm a mental health advocate so i have to thank you so much. >> reporter: just look at the reaction when they learn that marge was the woman who started it all. this year marks 40 years since marge and the friends of discovery started the thrift station. by the end of the year, they will have donated over $7 million to the discovery counseling center of the san ramon valley. >> the friends of discovery and marge have meant that we have

been able to keep our doors open. there is no way that we could offer the services that we offer at the fees that we charge and still stay in business. >> reporter: cathy is executive director at the discovery counseling center. >> just remarkable, marge. >> reporter: in the early days they were just trying to raise money for a drop-in center for troubled teens. >> they just wanted to give them someplace to go where they could possibly straighten themselves out. >> reporter: today, the center has interns, graduate students working toward their professional licenses, in every school in the san ramon valley school district. all are supervised and trained by a staff of licensed professionals. and at the drop-in clinic they see clients from the community six days a week. >> what they have been able to do with what was just an idea, a couple of women saying, well, we'll sell our extra clothes, it's just absolutely remarkable. >> reporter: marge says she just did what she could.
